Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the Atspots mobile application and related services (the “Service”) operated by AtSpots (“Atspots,” “we,” “us”).

By creating an account or using the Service, you agree to these Terms and our Privacy Policy (also at https://atspots.com/privacy).

1. Eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction) to use the Service. You represent that the information you provide is accurate and that you will comply with these Terms and applicable laws.

2. Account registration

• You are responsible for safeguarding your password and all activity under your account.
• You may maintain one account unless we approve otherwise.
• We may suspend or terminate accounts that violate these Terms or our policies.
• Account types: Rookie (guest/explorer) and Sophomore (venue host) modes are described in-app. Switching modes does not bypass safety or geofence rules.

3. The Service

Atspots helps users discover venues and events on a map, participate in geofenced venue chat, post moments, and manage venue profiles (Sophomore hosts).

3.1 Location and geofence

Certain features require physical presence at a venue. You agree not to circumvent geofence or access controls (including GPS spoofing). We may log location validation attempts for security and abuse prevention.

3.2 User content

You retain ownership of content you post. You grant Atspots a non-exclusive, worldwide, royalty-free license to host, display, and distribute your content solely to operate and promote the Service.

You agree not to post content that is illegal, harassing, hateful, sexually exploitative, infringing, spam, or otherwise harmful. We may remove content and suspend accounts at our discretion.

3.3 Venue hosts (Sophomore)

If you create or manage venues, you represent that you have authority to list the venue and that information (location, description, images) is accurate. You are responsible for compliance with local laws, permits, and venue policies.

4. Subscriptions and fees

4.1 Launch period — no subscription fees

At initial public launch, Atspots does not charge subscription fees for optional premium features (such as featured venue placement, priority discovery ranking, unlimited events, or increased profile visibility). Any subscription or billing UI may be disabled until we announce otherwise.

4.2 Future paid features

We plan to introduce optional paid subscriptions at a later date, which may include monthly or annual plans for venue hosts and visibility features for Rookies. When available:

• Pricing, billing interval, and features will be disclosed before you purchase
• Payments may be processed by Stripe, Apple App Store, and/or Google Play, subject to their terms
• Subscriptions may auto-renew until canceled in accordance with the payment provider’s rules
• Refunds are handled per the applicable store or Stripe policy and our posted refund rules
• Featured venue plans may require a minimum time since venue registration (e.g., six months), as stated at purchase

We will update these Terms and provide notice before charging fees. Continued use after fees take effect may require accepting updated Terms or completing a new purchase flow.

4.3 Taxes

You are responsible for applicable taxes unless we are required to collect them.

5. Acceptable use

You agree not to:

• Violate laws or others’ rights
• Harass, threaten, or impersonate others
• Scrape, reverse engineer, or overload the Service
• Bypass security, geofence, or rate limits
• Use the Service for unauthorized commercial solicitation
• Upload malware or attempt unauthorized access

We provide report and block tools; we may cooperate with law enforcement where appropriate.

6. Moderation and enforcement

We may review reports, automated flags, and conduct to enforce these Terms. Actions include warnings, mutes, suspensions, bans, and content removal. Admin decisions are generally final for platform integrity.

7. Third-party services

The Service relies on third parties (e.g., Supabase, map providers, push services, future payment processors). Their terms and privacy policies apply to their services.

8. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not guarantee uninterrupted or error-free operation, accuracy of user-generated venue information, or safety of in-person interactions. You meet others at your own risk. Follow local laws and exercise judgment in real-world venues.

9. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ATSPOTS AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) USD $100 OR (B) THE AMOUNTS YOU PAID US IN THE TWELVE (12) MONTHS BEFORE THE CLAIM (which may be zero during the launch period without subscriptions).

Some jurisdictions do not allow certain limitations; in those cases, our liability is limited to the fullest extent permitted.

10. Indemnification

You agree to indemnify and hold harmless Atspots from claims arising from your content, your use of the Service, or your violation of these Terms.

11. Termination

You may stop using the Service at any time. You may request account deletion as described in our the in-app Delete account flow (Home → Delete account).

We may suspend or terminate your access for violations or operational reasons. Provisions that by nature should survive (disclaimers, liability limits, indemnity, dispute resolution) will survive termination.

12. Changes to Terms

We may modify these Terms. We will post the updated version and update the “Last updated” date. Material changes may require additional notice or acceptance where required by law or app store rules.
